Taiwan Tax Residency & Income Tax Filing Q&A for Foreign Nationals Without Household Registration
As Taiwan continues to attract international talent and digital nomads, we break down the most essential tax residency and filing rules for foreign nationals living in Taiwan.
How do foreign nationals without a Taiwan ID determine if they are a “Tax Resident” or a “Non-Resident”?
A: Status is primarily determined by your cumulative days of stay in Taiwan.
Without household registration, your tax residency status is classified based on the total days you actually reside in Taiwan within a calendar year (January 1 to December 31):
- Resident Individual: Individuals who reside in Taiwan for a cumulative total of 183 days or more within a taxable year.
- Non-Resident Individual: Individuals who reside in Taiwan for a cumulative total of less than 183 days within a taxable year.
What are the differences in taxation and filing methods between Tax Residents and Non-Residents?
A: The tax calculation basis, applicable tax rates, and filing procedures differ completely.
| Item | Tax Resident (Stay ≥ 183 Days) | Non-Resident (Stay < 183 Days) |
|---|---|---|
| Filing Method | Must file an Annual Income Tax Return in May of the following year (or file an exit return before leaving) | Taxes are withheld at source by the withholding agent; generally, no independent tax return filing is required |
| Tax Rates | Progressive tax rates ranging from 5% to 40% based on tax brackets | • Salary: 6% if monthly salary does not exceed 1.5x the minimum wage; 18% if it exceeds. • Other Income (interest, rent, etc.): Mostly withheld at 20% |
| Exemptions & Deductions | Eligible for personal exemptions, standard/itemized deductions, salary special deductions, and basic living expense differences | Not eligible for personal exemptions and standard/itemized deductions |
If I qualify as a “Tax Resident,” what deductions are available to reduce my tax burden?
A: Tax residents enjoy deductions largely identical to local citizens, including:
- Personal Exemption: A fixed NTD exemption amount per person (subject to annual government announcements).
- Standard Deduction / Itemized Deductions: Choice of one.
- Special Deductions: Common options include salary income, savings and investment, physical/mental disability, educational tuition, and preschool education special deductions.
- Basic Living Expense Difference: If total household basic living expenses exceed the total exemptions and deductions, the difference can be deducted from total gross income.
Do foreign nationals need to report foreign-sourced income or remuneration from overseas employers?
A: It depends on your tax residency status and the nature of the income:
- As a “Non-Resident”: Only “Taiwan-sourced income” is taxable. Compensation for services rendered outside Taiwan paid by an overseas employer is exempt.
- As a “Tax Resident”:
- In addition to Taiwan-sourced income, remuneration received from an overseas employer for services rendered within Taiwan must also be consolidated and reported.
- Furthermore, if total household overseas income (including Hong Kong and Macau) reaches NTD 1 million or more, it must be included for evaluation under the Alternative Minimum Tax (AMT) regime.
How should foreign nationals without household registration file taxes? What if leaving Taiwan mid-year?
A: Filing timelines depend on your departure schedule:
- Regular Year-Round Residency (Resident): Must log in to the National Taxation Bureau’s Foreign Tax Online Filing System or visit local tax service counters between May 1 and May 31 each year.
- Departing Mid-Year and Not Returning (Resident Status): Must complete an exit tax filing within one week prior to departure.
- Appointing an Agent: If unable to file in person, you can authorize a tax-capable ROC citizen or Taiwanese spouse as your proxy to file on your behalf, attaching required documents such as your passport, ARC, and power of attorney.
